1. Scope of Application

1.1 These Terms of Service ("Terms") apply to all contracts concluded between HAYRA Active ("Seller") and consumers or businesses ("Customer") regarding products offered through the HAYRA Active online store.

1.2 A consumer is any natural person acting for purposes outside their trade, business, or profession.

1.3 A business customer is any natural or legal person acting in the exercise of their commercial or professional activities.

2. Conclusion of Contract

2.1 Product descriptions displayed in the HAYRA Active online store do not constitute legally binding offers but serve as an invitation for customers to submit an offer.

2.2 By completing the checkout process and clicking the order confirmation button, the customer submits a legally binding purchase offer.

2.3 HAYRA Active may accept the customer's offer within five (5) days by:

Sending an order confirmation via email;
Delivering the ordered products; or
Requesting payment from the customer.

The contract becomes effective when one of these actions occurs first.

2.4 Order processing is conducted electronically. Customers are responsible for ensuring that the email address provided is accurate and capable of receiving communications from HAYRA Active.

3. Right of Withdrawal

3.1 Consumers are entitled to a statutory right of withdrawal where applicable under local consumer protection laws.

3.2 Details regarding the withdrawal process, conditions, and exceptions can be found in the HAYRA Active Return & Refund Policy.

4. Prices and Payment Conditions

4.1 All prices displayed on the website are shown in the applicable currency and include VAT where required by law.

4.2 Additional shipping costs, taxes, duties, or import fees may be charged separately and will be displayed during checkout where applicable.

4.3 HAYRA Active accepts payment methods displayed during checkout, including but not limited to:

Shopify Payments
PayPal
Credit Cards
Debit Cards
Other supported payment providers

4.4 Payments are processed securely through trusted third-party payment processors.

5. Delivery and Shipping Conditions

5.1 Orders are delivered to the shipping address provided during checkout.

5.2 Delivery times are estimates only and may vary depending on location, customs procedures, weather conditions, or carrier delays.

5.3 If delivery fails due to incorrect customer information or customer unavailability, additional shipping charges may apply.

5.4 HAYRA Active reserves the right to cancel orders in cases of product unavailability, inventory errors, or circumstances beyond its control.

6. Retention of Title

All goods remain the property of HAYRA Active until full payment has been received.

7. Warranty

7.1 Customers are entitled to statutory warranty rights as provided under applicable consumer protection laws.

7.2 Warranty claims do not cover:

Normal wear and tear
Improper use
Negligence
Unauthorized modifications
Damage caused by misuse or failure to follow care instructions

7.3 Customers should inspect products upon receipt and report any defects within a reasonable period.

8. Liability

8.1 HAYRA Active shall be liable without limitation for:

Intentional misconduct
Gross negligence
Death or personal injury caused by negligence
Liability required under applicable product liability laws

8.2 Except where prohibited by law, HAYRA Active shall not be liable for:

Indirect damages
Consequential damages
Loss of profits
Business interruption
Loss of data

8.3 HAYRA Active's total liability shall not exceed the purchase price paid for the affected product.

9. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in the country where HAYRA Active is legally established.

Mandatory consumer protection rights under the laws of the customer's country of residence remain unaffected.

10. Alternative Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform:

HAYRA Active is not obligated and does not agree to participate in dispute resolution proceedings before a consumer arbitration board unless required by applicable law.

1. Toepassingsgebied

1.1 Deze Algemene Voorwaarden ("Voorwaarden") zijn van toepassing op alle overeenkomsten die worden gesloten tussen HAYRA Active ("Verkoper") en consumenten of zakelijke klanten ("Klant") met betrekking tot de producten die via de online winkel van HAYRA Active worden aangeboden.

1.2 Onder consument wordt verstaan iedere natuurlijke persoon die handelt voor doeleinden die niet hoofdzakelijk verband houden met een handels-, bedrijfs-, ambachts- of beroepsactiviteit.

1.3 Onder zakelijke klant wordt verstaan iedere natuurlijke of rechtspersoon die handelt in de uitoefening van een beroep of bedrijf.

2. Totstandkoming van de Overeenkomst

2.1 De productomschrijvingen op de website van HAYRA Active vormen geen bindend aanbod, maar een uitnodiging aan de klant om een bestelling te plaatsen.

2.2 Door het afronden van het bestelproces en het klikken op de bestelknop doet de klant een juridisch bindend aanbod tot aankoop.

2.3 HAYRA Active kan het aanbod van de klant binnen vijf (5) dagen accepteren door:

Een orderbevestiging per e-mail te versturen;
De bestelde producten te verzenden of leveren;
De betaling van de klant te verwerken of op te vragen.

De overeenkomst komt tot stand zodra één van bovenstaande handelingen plaatsvindt.

2.4 Bestellingen worden elektronisch verwerkt. De klant is verantwoordelijk voor het verstrekken van een correct e-mailadres waarop communicatie van HAYRA Active ontvangen kan worden.

3. Herroepingsrecht

3.1 Consumenten hebben recht op herroeping overeenkomstig de toepasselijke Europese en nationale consumentenwetgeving.

3.2 Meer informatie over het herroepingsrecht, de voorwaarden en uitzonderingen is opgenomen in het Retour- en Terugbetalingsbeleid van HAYRA Active.

4. Prijzen en Betalingsvoorwaarden

4.1 Alle vermelde prijzen zijn inclusief btw indien wettelijk vereist.

4.2 Eventuele verzendkosten, invoerrechten, belastingen of andere bijkomende kosten worden afzonderlijk vermeld tijdens het afrekenproces indien van toepassing.

4.3 HAYRA Active accepteert de betaalmethoden die tijdens het afrekenen beschikbaar worden gesteld, waaronder:

PayPal
Creditcards
Debitcards
Andere ondersteunde betaalmethoden

4.4 Alle betalingen worden veilig verwerkt via erkende externe betalingsproviders.

5. Leverings- en Verzendvoorwaarden

5.1 Bestellingen worden geleverd op het adres dat door de klant tijdens het bestelproces is opgegeven.

5.2 Vermelde levertijden zijn indicatief en kunnen afwijken door omstandigheden buiten de invloed van HAYRA Active, waaronder vertragingen bij vervoerders, douaneprocedures of overmacht.

5.3 Indien levering mislukt door foutieve adresgegevens of afwezigheid van de klant, kunnen aanvullende kosten in rekening worden gebracht.

5.4 HAYRA Active behoudt zich het recht voor om bestellingen te annuleren in geval van voorraadfouten, productonbeschikbaarheid of andere omstandigheden buiten haar redelijke controle.

6. Eigendomsvoorbehoud

Alle geleverde producten blijven eigendom van HAYRA Active totdat volledige betaling van het verschuldigde bedrag is ontvangen.

7. Garantie en Klachten

7.1 Op alle producten zijn de wettelijke garantievoorwaarden van toepassing.

7.2 Garantie dekt geen schade veroorzaakt door:

Normale slijtage
Onjuist gebruik
Verwaarlozing
Ongeautoriseerde wijzigingen
Het niet opvolgen van was- en onderhoudsinstructies

7.3 Klanten dienen producten direct na ontvangst te controleren en eventuele gebreken binnen een redelijke termijn te melden.

8. Aansprakelijkheid

8.1 HAYRA Active is onbeperkt aansprakelijk in geval van:

Opzet
Grove nalatigheid
Overlijden of lichamelijk letsel veroorzaakt door nalatigheid
Verplichte aansprakelijkheid op grond van toepasselijke wetgeving

8.2 Voor zover wettelijk toegestaan is HAYRA Active niet aansprakelijk voor:

Indirecte schade
Gevolgschade
Winstderving
Bedrijfsschade
Verlies van gegevens

8.3 De totale aansprakelijkheid van HAYRA Active is beperkt tot het bedrag dat door de klant voor het betreffende product is betaald.

9. Toepasselijk Recht

Op deze Voorwaarden is het recht van het land waarin HAYRA Active officieel is gevestigd van toepassing.

Dwingende consumentenrechten van het land waar de klant woonachtig is blijven onverminderd van kracht.

10. Alternatieve Geschillenbeslechting

De Europese Commissie biedt een platform voor online geschillenbeslechting (ODR):
